1.1 These Advertising Terms & Conditions apply to any dealer, trader, business, individual, or organisation that advertises vehicles, services, promotions, or related content on the CarVendors platform.
1.2 By creating an account, submitting a listing, uploading vehicle content, or using any paid or free advertising service offered by CarVendors, you agree to be bound by these Terms.
1.3 These Terms apply alongside any other CarVendors terms, policies, dealer agreements, payment terms, privacy policies, or written agreements agreed between you and CarVendors.
In these Terms:
"CarVendors", "we", "us", or "our" means the operator of the CarVendors website, platform, services, and associated advertising products. "Platform" means the CarVendors website, mobile website, applications, social media pages, digital services, and any other marketplace or advertising channels operated by CarVendors. "Advertiser", "you", or "your" means any person, dealer, trader, business, or organisation placing or managing an advertisement on the Platform. "Advertisement" means any vehicle listing, dealer profile, promotional content, sponsored placement, banner, offer, image, description, video, logo, price, finance example, or other material uploaded, supplied, or approved by you for publication. "Vehicle" means any car, van, motorcycle, commercial vehicle, or other vehicle advertised on the Platform. "Buyer" means any person or business viewing, enquiring about, reserving, or purchasing a Vehicle or service through or as a result of the Platform. "Services" means any advertising, listing, promotional, lead generation, dealer profile, CV Approved, or related services provided by CarVendors. "CV Approved" means a dealer approval status given by CarVendors to selected dealers who meet CarVendors' internal standards for authenticity, reliability, and trading conduct.
3.1 CarVendors provides an advertising and marketplace platform that allows Advertisers to promote Vehicles and related services to potential Buyers.
3.2 Unless expressly stated otherwise, CarVendors is not the seller, buyer, broker, agent, finance provider, insurer, vehicle checker, or party to any sale agreement between an Advertiser and a Buyer.
3.3 Any contract for the sale or purchase of a Vehicle is strictly between the Advertiser and the Buyer.
3.4 CarVendors does not guarantee that any Advertisement will result in views, enquiries, reservations, appointments, sales, finance applications, or completed transactions.
4.1 You may only advertise on CarVendors if you are legally entitled to do so.
4.2 Where you advertise a Vehicle, you confirm that: a. you own the Vehicle or have full authority to advertise and sell it; b. the Vehicle is not subject to any restriction preventing its advertisement or sale; c. all information provided in the Advertisement is accurate, complete, current, and not misleading; and d. you will comply with all applicable laws, regulations, codes, and industry standards.
4.3 Business Advertisers must provide accurate business information, including trading name, company details where applicable, contact details, address, VAT information where applicable, and any other information reasonably requested by CarVendors.
4.4 CarVendors may request evidence of identity, business status, ownership, authorisation, trading history, insurance, regulatory compliance, or any other information reasonably required before allowing or continuing advertising.
5.1 You are fully responsible for all Advertisement content submitted, uploaded, published, or approved by you.
5.2 Each Advertisement must be accurate, lawful, fair, clear, and not misleading.
5.3 Vehicle Advertisements must accurately describe, where relevant: a. make, model, derivative, trim, and specification; b. registration year and registration mark where required; c. mileage; d. price; e. fuel type, transmission, engine size, colour, body type, and number of doors; f. ownership, service history, MOT status, keys, and warranty information where stated; g. known faults, damage, accident history, write-off status, imported status, mileage discrepancies, outstanding finance, or other material information known to you; h. whether the Vehicle is available, reserved, sold, in preparation, or awaiting delivery; and i. any compulsory fees, administration charges, delivery charges, or other costs payable by the Buyer.
5.4 You must not omit information that a Buyer would reasonably need to make an informed decision.
5.5 You must update or remove an Advertisement promptly if any information becomes inaccurate, incomplete, misleading, outdated, or if the Vehicle is no longer available.
6.1 You must not upload, submit, publish, or approve any Advertisement that: a. is false, misleading, deceptive, or fraudulent; b. advertises a Vehicle you do not own or are not authorised to sell; c. uses incorrect mileage, price, specification, history, or images; d. hides material information about the Vehicle; e. includes bait pricing, fake discounts, unavailable stock, or misleading offers; f. infringes any intellectual property, privacy, publicity, or other third-party rights; g. contains offensive, abusive, discriminatory, obscene, defamatory, threatening, or unlawful content; h. contains viruses, malware, tracking tools, scraping tools, or harmful code; i. redirects users away from CarVendors in a misleading or unauthorised way; j. promotes illegal goods, services, finance arrangements, or activities; or k. damages or may damage the reputation, security, reliability, or operation of CarVendors.
6.2 CarVendors may reject, edit, suspend, remove, restrict, or block any Advertisement at any time if we reasonably believe it breaches these Terms, applicable law, platform standards, or customer trust expectations.
7.1 All advertised prices must be genuine, accurate, and inclusive of VAT where applicable, unless clearly and lawfully stated otherwise.
7.2 Any mandatory fees or charges must be clearly disclosed in the Advertisement.
7.3 You must not advertise a Vehicle at a price that you do not intend to honour.
7.4 If finance examples, monthly payments, representative APRs, deposits, or credit-related information are included in an Advertisement, you are responsible for ensuring that such information is accurate, compliant, authorised where required, and not misleading.
7.5 CarVendors does not provide financial advice and is not responsible for finance information supplied by Advertisers or third-party finance providers unless expressly agreed in writing.
8.1 All images, videos, logos, and media uploaded by you must be accurate, relevant, and lawful.
8.2 Vehicle images must fairly represent the Vehicle being advertised and must not materially mislead Buyers.
8.3 You must not use stock images, edited images, AI-generated images, or images of another vehicle unless this is clearly disclosed and permitted by CarVendors.
8.4 By uploading media to CarVendors, you confirm that you own or have permission to use that media.
9.1 CarVendors may review Advertisements before or after publication.
9.2 CarVendors is not obliged to publish any Advertisement.
9.3 CarVendors may delay, refuse, amend, remove, downgrade, suspend, or disable an Advertisement where we consider it necessary or appropriate.
9.4 Reasons may include, but are not limited to: suspected inaccuracy; suspected fraud; duplicate listings; poor quality content; breach of these Terms; legal or regulatory concerns; non-payment; customer complaints; technical issues; or protection of the Platform, users, or CarVendors' reputation.
9.5 Publication of an Advertisement does not mean CarVendors has verified, approved, endorsed, guaranteed, or accepted responsibility for its content.
10.1 Advertising packages, subscription plans, listing fees, promotional ch arges, lead generation fees, featured placement fees, or other charges will be set out separately on the Platform, invoice, order form, dealer agreement, or written communication.
10.2 You agree to pay all fees and charges applicable to the Services you se lect or use.
10.3 Unless otherwise agreed in writing, all fees are payable in advance and are non -refundable once the relevant Service has started, listing has gone live, or advertising space has been allocated.
10.4 CarVendors may change prices, packages, listing limits, features, and billing arrangements from time to time.
10.5 If payment is overdue, CarVendors may suspend your account; remove or restrict your Advertisements; withdraw promotional benefits; charge interest and reasonable recovery costs; re fuse further Services; and/or terminate your advertising access.
10.6 You remain liable for all outstanding sums owed to CarVendors.
11.1 Any statistics, analytics, lead volumes, impressions, click data, ranking, search visibi lity, or performance information provided by CarVendors is for general information only.
11.2 CarVendors does not guarantee number of views, number of enquiries, quality of leads, search ranking, sales conversion, buyer attendance, buyer affordability, or buyer completion.
11.3 Platform visibility may vary depending on user behaviour, search filters, stock availability, package type, listing quality, location, technical factors, and CarVendors' ranking systems.
12.1 CarVendors may provide you with Buyer enquiries, calls, messages, forms, email leads, appointment requests, or other contact opportunities.
12.2 You must use Buyer information only for responding to the relevant enquiry or progressing a legitimate vehicle-related transaction.
12.3 You must not sell, share, rent, transfer, or misuse Buyer data; send unrelated marketing without lawful consent; contact Buyers in a misleading, excessive, or unlawful manner; use Buyer data after it is no longer needed; or breach data protection laws.
12.4 You are responsible for complying with all applicable data protection, privacy, electronic marketing, and consumer protection laws when handling Buyer information.
13.1 Advertisers must act honestly, professionally, and responsibly when dealing with Buyers.
13.2 You must not pressure, mislead, harass, discriminate against, or unfairly treat Buyers.
13.3 You must respond to Buyer enquiries and complaints within a reasonable time.
13.4 You must honour accurate advertised prices and terms unless there is a genuine and obvious error, in which case you must inform the Buyer promptly.
13.5 You must not use CarVendors to redirect Buyers to fraudulent, unsafe, or unauthorised sales processes.
14.1 CarVendors may offer a CV Approved programme for selected dealers.
14.2 CV Approved status relates to the dealer's authenticity, reliability, trading conduct, and compliance with CarVendors' internal approval standards.
14.3 CV Approved status does not mean that CarVendors has inspected, certified, mechanically checked, history checked, guaranteed, or warranted any individual Vehicle.
14.4 CarVendors may grant, refuse, suspend, downgrade, or remove CV Approved status at any time.
14.5 CV Approved Dealers must maintain higher standards of conduct, listing accuracy, complaint handling, transparency, and customer service.
14.6 Repeated complaints, misleading listings, poor conduct, non-cooperation, or breach of these Terms may result in removal of CV Approved status and/or suspension from the Platform.
15.1 CarVendors does not provide vehicle history check reports, HPI-style reports, mechanical inspections, finance checks, stolen vehicle checks, write-off checks, mileage verification reports, or condition reports unless expressly stated in a separate written service agreement.
15.2 Any information displayed on the Platform regarding a Vehicle is provided by the Advertiser or third parties.
15.3 Buyers remain responsible for carrying out their own checks, inspections, and due diligence before purchasing a Vehicle.
15.4 Advertisers remain fully responsible for the accuracy of all Vehicle information they provide.
16.1 Advertisers must comply with all laws and regulations applicable to vehicle advertising and sales, including where applicable: consumer protection laws; trading standards requirements; advertising rules; vehicle roadworthiness requirements; data protection laws; distance selling laws where applicable; financial promotion and credit broking rules where applicable; and all relevant laws of England and Wales.
16.2 Advertisers must not use CarVendors in a way that causes CarVendors to breach any law, regulation, code, or third-party obligation.
16.3 If CarVendors receives a complaint, regulator enquiry, legal notice, or claim relating to your Advertisement or conduct, you must cooperate fully and promptly.
17.1 You retain ownership of the content you upload, subject to the rights granted to CarVendors under these Terms.
17.2 By uploading, submitting, or approving Advertisement content, you grant CarVendors a worldwide, non - exclusive, royalty-free, transferable licence to use, host, store, reproduce, publish, display, adapt, resize, edit, distribute, promote, and market that content in connection with the Platform and CarVendors' business.
17.3 This licence allows CarVendors to display your Advertisements on the Platform and promote them t hrough search engines, social media, emails, partner channels, advertising campaigns, and other marketing activity.
17.4 You confirm that you have all rights, permissions, licences, and consents required to grant this licence.
18.1 You must not scrape, copy, harvest, or extract Platform data without permission; interfere with Platform security or operation; reverse engineer or misuse Platform systems; create fake accounts or fake enquiries; manipulate rankings, reviews, enquiries, or listing visibility; use bots, automation, or unauthorised software; overload, damage, or disrupt the Platform; or use the Platform for any unlawful or unauthorised purpose.
18.2 CarVendors may monitor Platform use to protect users, prevent fraud, enforce these Terms, and improve Services.
19.1 You are responsible for maintaining the confidentiality and security of your account login details.
19.2 You are responsible for all activity carried out through your account.
19.3 You must notify CarVendors immediately if you suspect unauthorised access, misuse, fraud, or security compromise.
19.4 CarVendors may suspend access where we suspect unauthorised or unsafe account activity.
20.1 CarVendors may suspend, restrict, or terminate your account, Advertisements, Services, or access to the Platform at any time where we reasonably believe you have breached these Terms, failed to pay, provided false or misleading information, misused Buyer data, acted unlawfully or dishonestly, created legal or reputational risk, or where fraud or suspicious activity is suspected.
20.2 Suspension or termination does not affect any rights or liabilities accrued before the date of suspension or termination.
20.3 You must immediately stop using CarVendors branding, badges, CV Approved marks, or promotional materials if your access or approval status is removed.
21.1 CarVendors may investigate complaints relating to Advertisements, Dealers, Buyer experiences, data misuse, fraud, misleading information, or breach of these Terms.
21.2 You must provide documents, explanations, evidence, and cooperation reasonably requested by CarVendors.
21.3 CarVendors may take action based on the outcome of an investigation, including removal of listings, restriction of account access, removal of CV Approved status, reporting to authorities, or termination.
21.4 CarVendors may, at its discretion, facilitate communication between Buyers and Advertisers but is not required to resolve disputes or compensate either party.
22.1 CarVendors provides an advertising platform only.
22.2 To the fullest extent permitted by law, CarVendors is not liable for: the accuracy of Advertisements supplied by Advertisers; the condition, quality, history, mileage, roadworthiness, value, or legality of any Vehicle; any contract or dispute between a Buyer and Advertiser; loss of sales, revenue, profit, business, goodwill, or opportunity; reduced visibility, enquiries, or performance; technical issues, downtime, delays, or interruptions; unauthorised access caused by your failure to secure your account; indirect, consequential, or special losses; or any reliance placed on Platform content by users.
22.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot be excluded by law.
23.1 You agree to indemnify and hold CarVendors harmless against all claims, loss es, liabilities, damages, costs, expenses, penalties, legal fees, and regulatory action arising from or connected with your Advertisement, your Vehicle, your breach of these Terms, your breach of law or regulation, your misuse of Buyer data, your misrepresentation or failure to disclose material information, your infringement of third-party rights, or any dispute between you and a Buyer.
24.1 CarVendors may amend these Terms from time to time.
24.2 Updated Terms will be made available on the Platform or otherwise notified to you.
24.3 Continued use of the Platform after the updated Terms take effect will be treated as acceptance of the updated Terms.
24.4 If you do not agree to updated Terms, you must stop using the Services.
25.1 You may not transfer, assign, subcontract, or otherwise deal with your rights or obligations under these Terms without CarVendors' written consent.
25.2 CarVendors may transfer or assign its rights and obligations under these Terms to anothe r company, group company, buyer of its business, or service provider where appropriate.
26.1 If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts will continue in full force and effect.
26.2 The invalid or unenforceable part will be treated as modified to the minimum extent necessary to make it valid and enforceable.
27.1 If CarVendors does not immediately enforce any right under these Terms, this does not mean CarVendors has waived that right.
27.2 Any waiver must be given in writing.
28.1 These Terms are governed by the laws of England and Wales.
28.2 The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from or connected with these Terms, the Platform, or the Services.
1.1 These Car Finding Service Terms & Conditions apply whenever a customer asks CarVendors to help search for, identify, introduce, recommend, or source a vehicle based on the customer's requirements, preferences, budget, location, intended use, or other instructions.
1.2 These Terms apply whether the Car Finding Service is requested through the CarVendors website, telephone, email, social media, messaging platforms, online forms, in person, or through any other communication method.
1.3 These Terms apply in addition to CarVendors' general website terms, privacy policy, advertising terms, vehicle check terms, online enquiry and reservation terms, and any written agreement or order form agreed with the customer.
1.4 By submitting a car finding request, instructing CarVendors to search for a vehicle, paying any sourcing fee, or proceeding with a vehicle introduced by CarVendors, you agree to these Terms.
In these Terms:
"CarVendors", "we", "us", or "our" means the operator of the CarVendors platform and the provider of the Car Finding Service. "Customer", "you", or "your" means the person, business, or organisation requesting or using the Car Finding Service. "Car Finding Service" means the service by which CarVendors uses information provided by the Customer to search for, identify, shortlist, introduce, or assist in sourcing potential vehicles. "Vehicle" means any car, van, motorcycle, commercial vehicle, or other vehicle considered, suggested, sourced, introduced, reserved, purchased, or otherwise discussed as part of the Car Finding Service. "Seller" means the dealer, trader, private seller, auction, leasing company, finance company, partner supplier, or other third party offering a Vehicle for sale. "Dealer" means a motor trader or dealership selling or advertising vehicles. "Requirements" means the Customer's stated needs, preferences, budget, timescale, vehicle type, make, model, age, mileage, fuel type, transmission, usage, finance preference, part exchange information, location, delivery preference, or other instructions. "Sourcing Fee" means any fee, administration charge, search fee, success fee, reservation fee, introduction fee, commission, or other charge payable to CarVendors for the Car Finding Service. "Introduced Vehicle" means any Vehicle identified, suggested, sent, recommended, introduced, negotiated, reserved, or sourced by CarVendors for the Customer. "Purchase Contract" means the contract for the sale and purchase of a Vehicle.
3.1 CarVendors provides a vehicle search and introduction service designed to help Customers find vehicles that may match their Requirements.
3.2 The Car Finding Service may include, depending on the service requested and agreed:
a. discussing the Customer's needs and budget;
b. identifying suitable vehicle types, makes, models, specifications, or options;
c. searching dealer stock, marketplace listings, partner suppliers, auctions, trade contacts, or other available sources;
d. shortlisting potential Vehicles;
e. introducing the Customer to Sellers;
f. assisting with communication between the Customer and Seller;
g. providing general vehicle-related information;
h. assisting with viewing, reservation, collection, delivery, or handover arrangements; and/or
i. helping the Customer compare available options.
3.3 The exact scope of the Car Finding Service may vary depending on the Customer's Requirements, available vehicles, market conditions, location, budget, timescale, and any written agreement between the Customer and CarVendors.
3.4 Unless expressly agreed in writing, CarVendors does not act as the Seller of the Vehicle and does not own, inspect, repair, finance, insure, warrant, or guarantee any Introduced Vehicle.
4.1 CarVendors acts as a vehicle search, sourcing, introduction, and marketplace assistance service.
4.2 Unless expressly stated in writing, CarVendors is not:
a. the Seller of the Vehicle;
b. the Buyer's agent with authority to bind the Customer;
c. the Seller's agent with authority to bind the Seller;
d. a vehicle inspection company;
e. a vehicle history check provider;
f. a finance lender;
g. an insurer;
h. a warranty provider;
i. a legal adviser;
j. a tax adviser; or
k. a financial adviser.
4.3 Any Purchase Contract is normally between the Customer and the relevant Seller, unless CarVendors expressly confirms in writing that CarVendors is the seller.
4.4 CarVendors may receive payment from the Customer, the Seller, a Dealer, a finance provider, an advertising partner, or another third party, where permitted by law and disclosed where required.
5.1 The Customer must provide complete, accurate, and honest information about their Requirements.
5.2 The Customer is responsible for ensuring that their budget, intended use, finance position, licence status, insurance position, part exchange information, delivery requirements, and any other relevant details are accurate.
5.3 CarVendors will use reasonable care and skill when considering the Customer's Requirements and searching for suitable options. Under UK consumer law, services supplied by a trader must be carried out with reasonable care and skill.
5.4 CarVendors is entitled to rely on information provided by the Customer. CarVendors is not responsible for delays, unsuitable recommendations, missed opportunities, additional costs, or losses caused by incomplete, inaccurate, late, or misleading information provided by the Customer.
5.5 If the Customer changes their Requirements, budget, timescale, or instructions after the Car Finding Service has started, CarVendors may need to restart or revise the search and may charge additional fees if this has been agreed.
6.1 CarVendors will make reasonable efforts to identify suitable Vehicles based on the Customer's Requirements.
6.2 CarVendors does not guarantee that:
a. a suitable Vehicle will be found;
b. a Vehicle will be found within the Customer's budget;
c. a Vehicle will be found within the Customer's preferred timescale;
d. a Vehicle will remain available;
e. the Seller will agree to sell to the Customer;
f. the Customer will be approved for finance;
g. the Customer's part exchange valuation will be accepted;
h. the Customer will proceed with any Introduced Vehicle; or
i. the Customer will be satisfied with any available market options.
6.3 Vehicle availability, pricing, condition, mileage, specification, finance terms, delivery times, and seller willingness may change at any time.
6.4 CarVendors is not responsible if a Vehicle is sold, reserved, withdrawn, repriced, damaged, corrected, or otherwise becomes unavailable before the Customer proceeds.
7.1 CarVendors may suggest Vehicles that appear to match the Customer's Requirements based on available information.
7.2 Any suggestion, shortlist, recommendation, introduction, or comparison is based on information available to CarVendors at the relevant time.
7.3 CarVendors does not guarantee that any Introduced Vehicle is the best possible vehicle, the cheapest available vehicle, the most reliable vehicle, or the most suitable vehicle for the Customer's personal circumstances.
7.4 The Customer remains responsible for making the final decision on whether a Vehicle is suitable.
7.5 Before proceeding, the Customer should consider the Vehicle's age, mileage, price, running costs, insurance, tax, fuel type, ULEZ/CAZ requirements, service history, warranty, condition, finance cost, affordability, and intended use.
8.1 Vehicle information may be provided by Sellers, Dealers, advertisers, auction platforms, third-party websites, vehicle data sources, public records, or other external sources.
8.2 CarVendors does not guarantee that external information is accurate, complete, current, or free from error.
8.3 The Seller is responsible for the accuracy of information they provide about the Vehicle.
8.4 The Customer must verify all important information directly with the Seller before entering into a Purchase Contract.
8.5 Important information may include, without limitation:
a. price;
b. mileage;
c. specification;
d. service history;
e. MOT status;
f. warranty terms;
g. vehicle history;
h. accident or write-off status;
i. outstanding finance;
j. number of keys;
k. ownership history;
l. availability;
m. delivery charges;
n. administration fees; and
o. any known faults or defects.
Agreed
9.1 CarVendors does not provide vehicle history checks, HPI-style checks, outstanding finance checks, stolen vehicle checks, write-off checks, mileage verification, mechanical inspections, roadworthiness inspections, or condition reports unless expressly agreed in writing as a separate service.
9.2 Any vehicle check, inspection, report, or warranty arranged by a third party is subject to that third party's own terms and conditions.
9.3 CarVendors is not responsible for any third-party check, inspection, report, warranty, error, omission, or conclusion.
9.4 Customers are strongly encouraged to carry out their own checks and inspections before purchasing any Vehicle.
10.1 Before buying any Introduced Vehicle, the Customer should:
a. inspect the Vehicle in person where possible;
b. test drive the Vehicle where appropriate and lawful;
c. check the V5C/logbook;
d. verify the VIN/chassis number;
e. review service history and MOT history;
f. check mileage records;
g. ask about accident damage, write-off status, outstanding finance, imports, modifications, and faults;
h. obtain an independent vehicle history check if desired;
i. obtain an independent mechanical inspection if desired;
j. confirm warranty terms in writing;
k. confirm all fees, delivery charges, and admin charges; and
l. make sure all promises or agreed terms are put in writing by the Seller.
10.2 CarVendors is not responsible for a Customer's decision to proceed without carrying out checks, inspections, or due diligence.
11.1 CarVendors may charge a Sourcing Fee for the Car Finding Service.
11.2 Any applicable Sourcing Fee, payment timing, refund rules, and included services should be confirmed before the Customer instructs CarVendors to begin paid work.
11.3 Unless otherwise agreed in writing, a Sourcing Fee is payable for CarVendors' time, work, search activity, market research, administration, communication, and introduction service. It is not a payment towards the purchase price of any Vehicle.
11.4 CarVendors may charge different types of fees, including:
a. an upfront search fee;
b. an administration fee;
c. a success fee payable if the Customer proceeds with an Introduced Vehicle;
d. a reservation or holding assistance fee;
e. a delivery or collection arrangement fee; and/or
f. any other fee clearly agreed with the Customer.
11.5 Any fees payable to Sellers, Dealers, auction houses, finance providers, warranty providers, delivery providers, inspection providers, or other third parties are separate from CarVendors' Sourcing Fee unless expressly stated otherwise.
12.1 The refund status of any Sourcing Fee will depend on what was agreed with the Customer and how much of the Car Finding Service has been performed.
12.2 If the Customer is a consumer and enters into a service contract with CarVendors online, by telephone, or away from CarVendors' business premises, the Customer may have a 14-day cancellation period under the Consumer Contracts Regulations 2013. Those Regulations require certain pre-contract information and, in some circumstances, give consumers cancellation rights for distance and off-premises contracts.
12.3 If the Customer asks CarVendors to begin the Car Finding Service during the 14-day cancellation period, the Customer acknowledges that they may be required to pay for the work carried out up to the point of cancellation, where permitted by law.
12.4 If the Car Finding Service is fully performed during the cancellation period with the Customer's express request and acknowledgement, the Customer may lose the right to cancel once the service has been completed, where permitted by law.
12.5 CarVendors may refund a Sourcing Fee in full or in part where:
a. CarVendors has not started the Car Finding Service;
b. CarVendors cancels the service without carrying out meaningful work;
c. a refund is required by law; or
d. CarVendors agrees to a refund in writing.
12.6 Unless required by law or agreed in writing, CarVendors is not required to refund a Sourcing Fee merely because:
a. the Customer changes their mind;
b. the Customer changes their budget or Requirements;
c. the Customer rejects suitable options;
d. no Vehicle is found within the preferred timescale;
e. available Vehicles are outside the Customer's expectations;
f. a Vehicle is sold before the Customer proceeds;
g. finance is declined;
h. insurance is too expensive;
i. the Customer's part exchange value is lower than expected; or
j. the Customer chooses not to purchase any Introduced Vehicle.
13.1 In some cases, a Seller may require a deposit, reservation payment, holding payment, or similar payment to hold a Vehicle.
13.2 Unless expressly stated in writing, any deposit, reservation payment, or holding payment is paid to and controlled by the Seller, not CarVendors.
13.3 The Customer must check the Seller's deposit and refund terms before making any payment.
13.4 CarVendors is not responsible for any Seller's refusal to refund a deposit, cancellation of a reservation, sale of a Vehicle to another buyer, or failure to honour a holding arrangement.
13.5 If CarVendors collects a payment on behalf of a Seller, the payment terms, purpose of payment, refund rules, recipient, and cancellation position should be made clear to the Customer before payment is taken.
13.6 A reservation or holding arrangement does not guarantee that a Vehicle will be sold to the Customer unless the Seller expressly agrees this in writing.
14.1 Unless CarVendors expressly confirms that it is selling the Vehicle, the Purchase Contract is between the Customer and the Seller.
14.2 CarVendors is not a party to the Purchase Contract and is not responsible for the Seller's obligations under it.
14.3 The Customer should read and understand the Seller's terms before entering into a Purchase Contract.
14.4 The Customer should ensure that all agreed terms are confirmed in writing, including:
a. final price;
b. deposit terms;
c. refund terms;
d. delivery or collection arrangements;
e. warranty;
f. vehicle condition;
g. repairs or preparation work;
h. included accessories;
i. part exchange terms; and
j. cancellation rights.
15.1 Where a Customer buys a Vehicle from a trader, the Customer may have statutory rights under UK consumer law.
15.2 Under the Consumer Rights Act 2015, goods supplied by a trader to a consumer must generally be of satisfactory quality, fit for a particular purpose made known, and as described.
15.3 These statutory rights apply between the Customer and the Seller where the Seller is the trader selling the Vehicle.
15.4 CarVendors does not exclude or limit any statutory rights that a Customer may have against the Seller.
15.5 Nothing in these Terms is intended to reduce consumer rights that cannot legally be excluded.
16.1 CarVendors may identify Vehicles offered by private sellers, auctions, trade sources, partner suppliers, or other non-retail sources.
16.2 The Customer acknowledges that legal rights, warranties, cancellation rights, inspection opportunities, buyer protections, and risks may differ depending on the type of Seller and sales route.
16.3 Vehicles bought at auction, from private sellers, or through trade channels may carry higher risk and may offer fewer protections than vehicles bought from a consumer-facing dealer.
16.4 The Customer should take extra care and obtain independent advice or inspections where appropriate.
16.5 CarVendors is not responsible for the Customer's decision to purchase through a particular sales route.
17.1 CarVendors does not provide financial advice.
17.2 CarVendors does not act as a lender.
17.3 If CarVendors introduces the Customer to a finance provider, broker, lender, or finance product, this will be subject to separate finance terms and regulatory requirements.
17.4 Any finance approval, quote, interest rate, monthly payment, deposit, commission, affordability decision, or lending decision is controlled by the relevant finance provider or broker.
17.5 The Financial Conduct Authority regulates consumer credit and motor finance activity in the UK, and firms involved in credit broking or financial promotions may need appropriate permissions and compliant disclosures.
17.6 CarVendors will only carry out regulated credit broking or financial promotion activity where it is authorised, exempt, appointed, or otherwise legally permitted to do so.
17.7 The Customer must read all finance documents carefully and decide whether finance is affordable and suitable for their circumstances.
18.1 The Customer is responsible for checking insurance cost, road tax, MOT status, ULEZ/CAZ compliance, fuel cost, servicing cost, repair cost, warranty coverage, and other running costs before purchasing a Vehicle.
18.2 CarVendors may provide general information, but this should not be treated as a guarantee.
18.3 Charges, rules, restrictions, and vehicle compliance requirements may change.
18.4 The Customer should verify all such matters independently before purchasing.
19.1 CarVendors may help the Customer obtain an estimated part exchange valuation from a Seller or third party.
19.2 Any part exchange valuation is indicative only unless confirmed in writing by the party buying or accepting the part exchange vehicle.
19.3 Final part exchange values may depend on inspection, condition, mileage, service history, ownership, finance status, damage, market conditions, and other factors.
19.4 CarVendors is not responsible if a final part exchange value is lower than expected or if a Seller refuses to accept a part exchange.
20.1 CarVendors may help coordinate delivery, collection, or handover arrangements, but unless expressly agreed in writing, delivery is the responsibility of the Seller or delivery provider.
20.2 Delivery costs, timescales, insurance, damage risk, cancellation, failed delivery, and handover requirements should be agreed directly with the Seller or delivery provider.
20.3 CarVendors is not responsible for delivery delays, delivery damage, failed handover, or additional delivery costs unless caused directly by CarVendors' own breach of these Terms.
21.1 The Customer is not required to buy a Vehicle merely because CarVendors has introduced it.
21.2 However, CarVendors is not required to continue searching indefinitely.
21.3 CarVendors may pause, end, or revise the Car Finding Service where:
a. the Customer repeatedly rejects vehicles that reasonably match the Requirements;
b. the Customer's Requirements are unrealistic for the budget;
c. the Customer does not respond within a reasonable time;
d. the Customer changes Requirements repeatedly;
e. suitable vehicles are not available in the market;
f. the Customer fails to pay agreed fees; or
g. continuing the search is not commercially reasonable.
22.1 Any timescale given by CarVendors is an estimate only unless expressly agreed in writing as binding.
22.2 Vehicle sourcing times may depend on market availability, Customer budget, vehicle type, specification, location, finance approval, Seller response times, inspection availability, and other external factors.
22.3 CarVendors is not liable for delays caused by Sellers, finance providers, inspection companies, delivery providers, auctions, third-party platforms, or the Customer.
23.1 CarVendors may communicate with Sellers on behalf of the Customer for the purpose of identifying, discussing, negotiating, or arranging potential Vehicles.
23.2 Unless expressly authorised in writing, CarVendors does not have authority to enter into a Purchase Contract, finance agreement, reservation agreement, deposit agreement, warranty agreement, or any other binding agreement on behalf of the Customer.
23.3 The Customer must personally approve any final purchase, finance, deposit, reservation, delivery, warranty, or part exchange arrangement.
24.1 CarVendors aims to act honestly and transparently when providing the Car Finding Service.
24.2 UK consumer protection law prohibits unfair commercial practices, including misleading actions and misleading omissions that may cause consumers to make transactional decisions they would not otherwise have made.
24.3 CarVendors will take reasonable steps to avoid giving misleading information about the Car Finding Service, fees, vehicle options, Sellers, and CarVendors' role.
24.4 Customers must also provide honest and accurate information to CarVendors.
25.1 If the Customer is unhappy with the Car Finding Service, they should contact CarVendors as soon as possible.
25.2 CarVendors may ask for details, documents, communications, payment records, vehicle information, Seller information, and other evidence to review the complaint.
25.3 Where a complaint relates to a Seller, Vehicle, finance provider, warranty provider, inspection provider, delivery provider, or other third party, CarVendors may assist with communication where appropriate but is not responsible for resolving the dispute unless legally required or expressly agreed.
25.4 Complaints about the Vehicle itself should usually be raised directly with the Seller.
26.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of statutory rights that cannot be excluded, or any other liability that cannot legally be excluded.
26.2 Subject to clause 26.1, CarVendors is not liable for:
a. the condition, quality, safety, roadworthiness, history, mileage, value, legality, finance status, stolen status, write-off status, reliability, or suitability of any Vehicle;
b. inaccurate, incomplete, delayed, or misleading information provided by Sellers or third parties;
c. any Purchase Contract between the Customer and Seller;
d. any deposit, reservation payment, refund, warranty, repair, cancellation, finance agreement, or part exchange arrangement controlled by a Seller or third party;
e. finance refusal, affordability decisions, interest rates, or lending terms;
f. insurance refusal or high insurance cost;
g. vehicle unavailability, price changes, or seller withdrawal;
h. loss caused by the Customer's failure to carry out checks or inspections;
i. loss of profit, loss of business, loss of opportunity, loss of savings, or indirect or consequential loss; or
j. third-party acts, omissions, delays, errors, or failures.
26.3 Subject to clause 26.1, where CarVendors is liable for breach of the Car Finding Service, CarVendors' liability shall be limited to the amount of the Sourcing Fee paid by the Customer for that specific Car Finding Service, unless a higher limit is required by law or agreed in writing.
27.1 Where the Customer is acting as a business, trader, dealer, or commercial buyer, the Customer agrees to indemnify CarVendors against claims, losses, liabilities, costs, expenses, and damages arising from:
a. inaccurate information provided by the Customer;
b. breach of these Terms;
c. misuse of the Car Finding Service;
d. unlawful resale, export, or commercial use of a sourced Vehicle; or
e. disputes caused by the Customer's own acts or omissions.
27.2 This clause does not apply to consumers in a way that would unfairly restrict their legal rights.
28.1 CarVendors will process personal data in accordance with its Privacy Policy.
28.2 The Customer agrees that CarVendors may use the information provided by the Customer to deliver the Car Finding Service.
28.3 This may include sharing relevant information with Sellers, Dealers, finance providers, inspection providers, delivery providers, warranty providers, or other third parties where necessary to progress the Customer's enquiry, subject to applicable data protection laws.
28.4 The Customer must ensure that any personal data they provide is accurate and that they have permission to provide it where it relates to another person.
29.1 CarVendors may end or suspend the Car Finding Service if:
a. the Customer breaches these Terms;
b. the Customer fails to pay agreed fees;
c. the Customer provides false or misleading information;
d. the Customer acts abusively, dishonestly, or unlawfully;
e. CarVendors cannot reasonably meet the Customer's Requirements;
f. continuing the search is commercially unreasonable;
g. no suitable vehicles are available; or
h. CarVendors is required to do so for legal, regulatory, safety, or operational reasons.
29.2 The Customer may ask CarVendors to stop the Car Finding Service at any time, subject to any agreed fees, refund rules, and cancellation rights.
29.3 Ending the service does not affect rights or liabilities that have already arisen.
30.1 CarVendors may update these Terms from time to time.
30.2 The Terms that apply to a Customer's Car Finding Service will usually be the Terms in force when the Customer instructed CarVendors, unless a change is required by law or agreed with the Customer.
30.3 Updated Terms may be published on the CarVendors website or otherwise made available.
31.1 If any part of these Terms is found to be invalid, unlawful, or unenforceable, the remaining parts will continue in full force and effect.
31.2 If CarVendors does not immediately enforce any right under these Terms, this does not mean that CarVendors has waived that right.
31.3 These Terms do not create a partnership, employment relationship, joint venture, fiduciary relationship, or regulated advisory relationship between CarVendors and the Customer.
31.4 The Customer may not transfer their rights or obligations under these Terms without CarVendors' written consent.
31.5 CarVendors may transfer its rights and obligations under these Terms to another business, group company, purchaser of its business, or service provider where lawful and appropriate.
32.1 These Terms are governed by the laws of England and Wales.
32.2 The courts of England and Wales shall have exclusive jurisdiction over disputes arising from or connected with these Terms, except where consumer law gives the Customer the right to bring proceedings in another UK jurisdiction.
